The Nasdaq Stock Market has accepted OCZ technology's plan to regain compliance with Nasdaq Listing Rule 5250, which will permit the continued listing of the company's stock on the Nasdaq Capital Markets.

On December 17, 2012, the OCZ submitted to Nasdaq a plan to regain compliance with Nasdaq's rule. After reviewing the company's plan to regain compliance, Nasdaq granted an exception to enable the company to regain compliance with the rule. Under the terms of the exception, on or before February 28, 2013, OCZ must file its 10-Q for the period ended August 31, 2012 and all other delinquent periodic reports.
