 ITC to Review Ruling In Patent Dispute Between Nokia and HTC

Message Text: The U.S. International Trade Commission on Monday said it would review a preliminary decision that found that HTC infringed on Nokia patents.

On September 23, 2013, the the presiding administrative law judge (ALJ) found that the Taiwanese smartphone maker HTC infringed two Nokia patents. The infringed patents cover a method for receiving and transmitting radio signals, and a method for eliminating unwanted signals.

The judge recommended that a limited exclusion order issue against all infringing articles imported, sold for importation, or sold after importation by HTC. The ALJ also recommended that a cease-and-desist order issue against HTC.

On October 23, 2013, HTC filed a petition for review challenging several grounds for the ALJ's determination. On October 31, 2013, Nokia filed a response in opposition to HTC's petition.

Having examined the record of this investigation, the FTC has determined to review the ruling in part.

After the ITC has completed its review, it could issue an order resulting in an import ban on infringing products.
