Oracle, SAP Settle Lawsuit

Oracle and SAP have settled a copyright litigation for $356.7 million over improper downloads of Oracle files, ending a long-running legal battle between the two enterprise software rivals. The case involved SAP's TomorrowNow unit, which the German company bought to provide software support to Oracle customers at lower rates than what Oracle charged.

Oracle was sued SAP in 2007 on allegations that its now-defunct subsidiary, TomorrowNow, had illegally downloaded Oracle’s software while providing software support services to Oracle customers. A California jury awarded Oracle $1.3 billion in 2010, but that amount was knocked down in subsequent judicial rulings by U.S. District Judge Phyllis Hamilton. Earlier this year a federal appeals court said Oracle could either accept $356.7 million, or opt for a retrial against SAP.

Under the settlement proposed to the court, Oracle will receive $356.7 million in damages and $2.5 million in post-judgment interest, according to a filing Thursday in the U.S. District Court for the Northern District of California, Oakland division. Oracle also gets to keep the $120 million already paid to it by SAP towards lawyers’ fees and other costs incurred to prosecute the case.
