Apple, Samsung Reach Settlement Over Patent Disputes

Apple, Samsung Reach Settlement Over Patent Disputes

Smartphones Jun 27,2018 0

Apple and Samsung Electronics on Wednesday settled a seven-year patent dispute, according to a settlement filed in the U.S. District Court for the Northern District of California.

"Whereas the court has been advised by the parties that the above-entitled action has been settled, all remaining claims and counterclaims in this case are hereby dismissed with prejudice, to the extent such are still pending, and all parties shall bear their own attorneys' fees and costs," the San Jose Division of the United States District Court in the Northern District of California said in an order of dismissal statement.

Samsung declined to provide details about the pricey settlement, citing a non-disclosure agreement. A Samsung spokesman said the company has finally called a truce with Apple, added the firm can't release specifics about the settlement under the non-disclosure agreement approved by the court.

Samsung and Apple had previously agreed to end the fight in other countries.

In May, a U.S. jury awarded Apple $539 million, after Samsung had previously paid Apple $399 million to compensate for patent infringement. Samsung would need to make an additional payment to Apple of nearly $140 million if the verdict was upheld.

The case has had an impact on U.S. patent law. After a loss at trial, Samsung appealed to the U.S. Supreme Court. In December 2016, the court sided with Samsung's argument that a patent violator does not have to hand over the entire profit it made from stolen designs if those designs covered only certain portions of a product but not the entire object.

Samsung has seen a rise in its smartphone business. Before 2011, Samsung was a second-tier smarpthone supplier, but became the industry leader.

Samsung uses a vertical integration structure between parts and finished goods, and supplied phones with competitive functions and at lower prices. On the other hand, Apple buys iPhone parts from various sources and depends on them.
