CyberLink Responds to InterVideo's Allegation of Patent Infringement

CyberLink yesterday responded to the allegation from InterVideo Inc. concerning a request to the International Trade Commission (ITC) of the US Government to investigate alleged patent infringement by CyberLink Corporation. Intervideo on Tuesday asked the ITC to investigate whether its Patent No. 6,765,788 which covers personal computer and electronic device functions has been infringed by a number of companies, including Cyberlink. The patent is entitled "Method and apparatus for integrating personal computer and electronic device functions," and the company claimed that it the infringement is especially concerning InterVideo's InstantON products and technology.

CyberLink said that it has not received any official notification from the ITC yet.

"CyberLink is a strong proponent of intellectual property rights. CyberLink believes that its technology and products do not infringe InterVideo's patent. Should official notification be made, CyberLink will respond to any ITC proceeding as appropriate and is confident of a favorable outcome," said Cyberlink today in an official press release.

Based on information available on the US Patent Office website, the patent at issue is now being re-examined by the US Patent Office.

Consequently, if the US Patent Office issues a final action to reject this patent, InterVideo Inc. will lose its grounds for this latest ITC proceeding.

Intervideo said that Dell Inc. and Winbook Computer Corporation have also infringed the specific patent.

In August 2005, Intervideo had filled another patent infringement lawsuit against Dell in the Northern District of California for infringement of the '788 patent. That suit is still pending.
