Sanyo fills Lawsuit against Sankyo Corporation
Sharp Corporation filed with the Tokyo District Court a counterclaim to
the lawsuit filed on April 12, 2005 by Sankyo Corporation based on Law for
the Prevention of Unfair Competition.
Acccording to Sharp, the lawsuit is based on the fact that the press release by Sankyo Corporation contains false allegations and as a
result, injured the Sharp brand. The lawsuit seeks the following relief
based on Law for the Prevention of Unfair Competition;
-1: Injunction of false allegations
-2: Compensation for monetary damages
-3: Publication of apology ad by Sankyo Corporation
Sharp also received today a copy of the trial decision by the Japan Patent Office as regards Sharps patent No.2106809 related to correction of defective pixels.
Since the Patent Office ruled one of three claimed invention as valid and the remaining two claimed inventions as invalid, Sharp immediately filed an action with the Intellectual Property High Court for annulment of the trial decision by the Patent Office, and after through examination of the trial decision, is also considering demanding a trial for correction with the Patent Office.
In addition, Sharp filed a patent infringement lawsuit with the Tokyo District Court against Sankyo Corporation as regards to 20 LCD TVs manufactured by TECO Electric and Machinery of Taiwan and imported and sold by Sankyo Corporation for infringement of backlight patent No.2823993 and optical sheet patent No.3437899 in addition to the defective pixels correction patent No.2106809.
Further, Sharp filed with the Tokyo Customs Office for injunction of importation based on infringement of above patents No.2106809 and No.2823993, and the Tokyo Customs Office accepted the filing.
If further infringement is found, Sharp plans to exercise its patent rights in addition to those above, since Sharp owns numerous LCD related patents.
